For example, the circumstances surrounding Mr. Benoit’s death were so tragic and so horrifying that it would have been reasonable for his fellow wrestlers to follow news developments about him and about CTE, through which they could have deduced that they were at risk of developing CTE and sought medical opinions about risks to their own health. This information was widely available in public news sources, such that WWE did not have superior access to it, and could not have thwarted any attempted investigation. Tolling on the basis of fraudulent concealment is therefore baseless." - page 33 The plaintiff's counsel were repeatedly criticised for including irrelevant information, for example "Plaintiffs have asserted numerous patently time-barred claims that have nothing to do with Plaintiffs’ alleged head trauma, any long-term consequences of such trauma, or WWE’s concealment of the risk that such trauma could cause permanent degenerative neurological conditions." - page 33 And also "This non-exhaustive list of irrelevant allegations seems to have had little to no effect on Attorney Kyros’ decision-making, because the SAC still lists WWE’s revenues, observations that former wrestler and non-party Jesse Ventura made on a television show, and the fact that WWE did not provide wrestlers with health insurance. In addition to these irrelevant allegations are numerous others, including a list of physical injuries that have nothing to do with concussions or head trauma, incurred by several Plaintiffs in the ring." - page 36 Earlier on the same page it really does summarise the problem with the lawsuit in layman's terms "What is really at issue in this case is whether WWE knew of the risk that repeated head trauma could cause permanent degenerative neurological conditions, fraudulently failed to disclose these risks to wrestlers, and then fraudulently concealed facts which it had a legal duty to disclose that would have given rise to legal claims between each Plaintiff’s retirement and the date that this action was filed. Whether WWE currently is or could be in possession of evidence that concussions can cause CTE is immaterial." - page 36 As the decision mentions earlier, there appears to have been no evidence presented prior to 2007 that WWE were aware of CTE problems, and even after the Benoit murder-suicide the court isn't prepared to accept that WWE should be aware of a probable link based on that one case. So while Ashley Massaro's affidavit details truly appalling treatment by WWE, knee injuries, non-head injuries and a rape are nothing to do with the lawsuit. The key issue, as the decision makes clear, is whether WWE were aware of the dangers of CTE, head trauma etc and knowingly concealed that from their wrestlers. And as stated earlier IANAL, but I don't see anything in Ashley Massaro's affidavit that proves they do, only an assertion that "I was never informed of the long-term risks associated with concussions or repeated head trauma and I had never even heard the terms TBI or CTE mentioned", which is worthless unless they can prove WWE knew about those long-term risks and intentionally concealed them. And yes I'm sure we all have an opinion about whether WWE did or didn't know, but you can hardly blame a court for insisting on actual proof. Especially if a person only had a few years in it and came through via a Diva search where they got a better downside than 90% of the female roster. But you wont hear a bad word said against her from the people she worked with. They all liked her. All considered her a friend. That's why its crazy to think she made that story up. She had problems, but she wasnt a problem. She never had a rep as a trouble maker or an attention seeker or someone who was bitter. She was just a nice woman who had injuries and a some demons. The fact that the WWE have brought up her attorney and a history of false claims, suggests they’re confident that, true or not, they’ve got this one covered from all angles. But, whether it’s true or not isn’t necessarily important now that Ashley is gone (as harsh as that is to say). What’s more important is that most people who read the story thought it could be true - and if that’s the case, this company still deserves everything it gets.
